Senator Joe Manchin of West Virginia and Democratic Leadership are forcing Congress to vote on a bill this year that would make it easier to build new mines and dirty fossil fuel projects like pipelines. This legislation would harm frontline communities and worsen the climate crisis.
With your help, we successfully kept the dirty deal off the September government funding bill. But Manchin’s back-up plan is to add his pro-fossil fuel language to the National Defense Authorization Act (NDAA).
By attaching the dirty deal to must-pass legislation, Manchin and Democratic Leadership are making this vote unfairly difficult for members of Congress who want to do the right thing and stand up for environmental justice.
The best path forward is to demand that the dirty deal get a separate vote from any must-pass legislation. Then we can defeat Manchin’s giveaway to the fossil fuel and mining industries, and defend our environmental laws!
Members Speaking Out
The following members of Congress are speaking out publicly against this dirty deal that seeks to gut our environmental laws and perpetuate sacrifice zones:
Sen. Cory Booker
NEW JERSEY
Sen. Cory Booker (NJ) signed onto a Senate letter of opposition and voted against adding the Dirty Deal to the Senate NDAA.
Sen. Cory Booker (NJ) voted against adding the Dirty Deal to the Senate NDAA.
Sen. Tim Kaine (VA) released a statement opposing the Mountain Valley Pipeline provisions and voted against adding the Dirty Deal to the Senate NDAA.
“I cannot support the Mountain Valley Pipeline-related provisions in this legislative text… Such a deliberate action by Congress to put its thumb on the scale and simply approve this project while shutting down opportunities for full administrative or judicial review is at odds with the bipartisan desire to have a more transparent and workable permitting process.” — Sen. Time Kaine
Sen. Ed Markey (MA) has spoken publicly on Twitter, signed onto a Senate letter of opposition, and voted against adding the Dirty Deal to the Senate NDAA.
“As we discuss whether this package can reflect the values of environmental justice and a path forward, especially as anti-environment proposals are brought forth, we shouldn't attach the permitting overhaul package to the must-pass government funding legislation.” — Sen. Ed Markey
Sen. Jeff Merkley (OR) has spoken publicly on Twitter, led a Senate letter of opposition, and voted against adding the Dirty Deal to the Senate NDAA.
“Changes to the permitting process should strengthen—not steamroll—public participation. I share the concerns of environmental justice advocates that expediting fossil fuel permitting will further harm the health of frontline communities already overburdened by pollution.” — Sen. Jeff Merkley
“Combating climate change is more important than fossil fuel profits. I will not vote for any bill that makes it easier for Big Oil to destroy the planet and that includes approving the Mountain Valley Pipeline. The Continuing Resolution must not be held hostage by Big Oil.” — Sen. Bernie Sanders
“To beat climate change we must break away from fossil fuel infrastructure. Not double down. Secret Senate permit reform side deal comes at expense of environmental laws & communities of color. I oppose it. Does not belong in a must-pass spending bill to keep government open.” — Rep. Nanette Barragán
“This #DirtyDeal was written by the fossil fuel industry. Most of us in Congress, and therefore our constituents, were not at the table. Impacted communities were not at the table. We cannot allow them to be sacrificed for even more planet-destroying profits.” — Rep. Jamaal Bowman
"I will not allow environmental justice communities to be used as bargaining chips by politicians intent on gutting environmental protection laws for profit." — Rep. Cori Bush
"The back-door deal that gave Big Oil a voice in the Inflation Reduction Act not only undermines NEPA and the Clean Water Act, but revives the disastrous Mountain Valley Pipeline and puts untold communities of color in danger. Climate injustice is a crisis. Let's act like it." — Rep. Yvette Clarke
“Environmental justice communities know all too well that permitting reform is nothing more than industry code for the systematic gutting of our most foundational protections, like NEPA. Polluting industries may have won that promise in a deal with a select few, but I intend to do everything in my power to convince the rest of my colleagues to break it.” — Rep. Raúl Grijalva
“I am not going to be steamrolled into a bunch of fossil fuel giveaways just because Manchin cut a deal in a closed room with Chuck Schumer. He doesn’t get to run the show on something like this, and many of us will have a say on what that deal looks like if it even happens." — Rep. Jared Huffman
"Let me be clear, we cannot sell out frontline communities to the fossil fuel industry. I will not support any new laws that provide additional corporate welfare to the fossil fuel industry." — Rep. Ro Khanna
“Upon reviewing the permitting reform bill, I am proud to stand with Rep Raul Grijalva and nearly 80 of my colleagues. The #DirtyDeal locks in another generation of fossil fuel infrastructure heating the planet. It has no place in a government funding bill.” — Rep. Carolyn Maloney
“Congress must keep the government open, but measures that weaken public input into permitting decisions should have to stand up to scrutiny on their own. I strongly oppose adding the #DirtyDeal to the Continuing Resolution.” — Rep. Betty McCollum
There are no circumstances under which I can see voting for the Manchin bill in the format that it's in, whether it's stand alone or attached to a must pass bill." — Rep. Donald McEachin
"Low-income and communities of color consistently bear the brunt when trying to protect their environmental rights. That is why I and 71 colleagues are urging House leaders to oppose any plan that would include anti-environmental provisions in any must pass legislation this year." — Rep. Grace Meng
“This month, I joined Rep Raul Grijalva in calling for a CR that doesn't force Members to choose between protecting frontline communities & funding the gov. I will continue to fight against any proposal to rubber-stamp the Mountain Valley Pipeline & other fossil fuel proposals.” — Rep. Jerry Nadler
“Earlier this month, I stood with Rep Raul Grijalva in calling for a CR that won't make Members choose between funding our government and protecting our environment and public health. We must keep our communities safe from the harms of fossil fuels.” — Rep. Jan Schakowsky
“I was proud to sign Rep Raul Grijalva's letter to underscore the importance of keeping the government funding bill free from polluting policies that disproportionately harm frontline communities.” — Rep. Bobby Scott
“Handshake deals made by others in closed rooms do not dictate how I vote, and we sure as hell don't owe Joe Manchin anything now. He and his fossil fuel donors already got far too much in the IRA.” — Rep. Rashida Tlaib
If your member of Congress is not shown above, call their office and tell them to publicly oppose any deal that requires building the Mountain Valley Pipeline and attacks our environmental laws!
Here’s an example script: “As a constituent, I’m calling to demand that you publicly oppose Senator Manchin’s permitting proposal. I urge you to stand with the communities impacted by fossil fuels and the climate crisis and stop this dirty deal!”
